Review about Funds On Hold

I have NEVER received a letter from this company but they have managed to attain my bank account information and have put a hold on my funds. I try to call them at the number provided by my bank and the number belongs to Midland credit...everytime I call I get a recording. I found a different number for Midland Credit Mgmt and called it. They have no idea what is going on and state they have no legal action against me. The amount they have placed on my bank account will take me 3 months to pay...I guess I'm supposed to lose my house, have all of my utilities cut off and lose my children's ins because of this company's illegal siezure of my bank account. I have no idea who they are or what this is for

I am not sure how come this company continues to do illegal actions, and the courts and judges just continue to allow it. Back in 2006 we were one of families hit with the increase of high interest rates on our home we lived in for 13 yrs, and almost went to foreclosure, I had lost my job due to medical reasons, all in the same year I kept paying the high payments on the house but a few of our credit cards got real behind, all my creditors worked with me except, for Capitol one Chase and citi, at Most I owed 2 of the cards were $500 and one was $1000, max limit.

But as the story goes they kept charging late fees and then the late fees caused it to go over limit then the over limit fees started, none of these three co worked with us. We short sold on our home, and the credit card companies put a judgement on us, all in this one yr, 500 charges turned into oweing them thousands, These companies did a charge off and damaged our credit, but then the fun began three other companies bought these and they doubled the amount I owed, and reported as well on my credit, and then asset acceptance bought it out in 2010 4 yrs later, and now on one card alone they said we owed 12 thousand dollars, on the other on 8000 and on another 14 thousand, how does 500 turn into 12 thousand. I requested a detailed bill from the begining on all charges they refused, and to this day dec 2013 they refuse. In 2011 they went into our saving account which we had just gotten passed on to us from the passing of a loved one.

They took 12 thousand out of our bank account without notice warning, letters etc. left us 56 dollars to our name. No proof of debt nothing. We went and had to file a wage exemption that took us 4 months to get to court, for the judge to only give us back 3000 dollars and give asset acceptance 8300.

for what no proof of us owing this nothing. The judge just gave them the money. And gave us a satisfaction letter. And now 2 years later My husband receives his check and its 500 less, no notice no letters nothing, asset acceptance is garnishing us again for what ?

The 3000 the judge gave back to us now it turns into 8900. When we have a satisfaction letter from 2 years ago. When does this maddness stop, and how can they just go to the court house and order a garnishment of funds with no proof, or charges they made up. Due to our dismay, we are again broke because of the money they took and cannot afford lawyer.

This company needs to be sued for the illegal actions they keep doing to people. I understand having a negative on my credit report at first by capitol one and chase and citi.

But why does the law allow these companies to sell over and over, and report over and over to where the consumer cannot fix the problem even if they wanted to, because of all the charges.

In 2010 they took $17000 from our bank account without providing any validation whatsoever. This was for a $5000 debt that we acquired in 1995 and had paid over $8000 on the debt before Asset Acceptance took our funds. The really sad thing about it is that the courts allowed it.

First all you are not helpless or hopeless, that is what these debt buyers want you to think and feel. Check your FDCPA and FCRA laws on the internet there is a lot of information that may help you find out that Asset Acceptance maybe breaking the law and you maybe able to sue them or at least get them to stop harassing you.

Check your credit reports and see if they are still reporting your paid in full debt to the credit bureau as unpaid. Call all three credit bureaus and get a copy of you credit report. You are entitled one free each year from each bureau and dispute with each one in writing any information you know is false. Illegal credit reporting is a federal offense.

If you prove that they are putting false information in your credit files make copies and send to credit bureaus. Credit bureaus are not allowed to report false information, Be clear and precise when disputing. Remind them of the FDCPA and FCRA laws after you have studied them yourself. Complain to the CFPB and FTC and even tell your story to you Attorney General.

Some consumer lawyers will give you free consultation and also check your local Legal Aid Service. Look online and find attorneys who have fought won against Asset Acceptance or any debt buyer that has committed illegal tactic against consumers. These are just a few suggestions.

This company has garnish my wages without sending me any court notice to appear in court or to show me that this was my account. The contact number does not work and I work a few blocks away from their so called office but there is never anyone there. I called the Justice department and found out that they are under a investigation for illegal debt collection.

They have been harassing me for some time now, over an electric bill they say I owe from 2000. I was separated and the house was sold.

When my ex-wife sold the house she had to prove there were no outstanding bills. She did not keep 14 year old bills. I have asked for a copy of the bill, AA says they do not have one. I have contacted the electric company, I have a friend who knows people in high places at the electric company.

They say they do not have the bill.

I agree AA needs to be taken to task. I don't know how anyone can get into a bank account with no proof.

14 years, your debt has probably reached the Statute of Limitations in your state so look up what your state's Statute of Limitations and when they call, tell them that!!

Anyone ever get a letter offering a large REFUND??

I recently received a letter from AA stating my estranged father, who I'm sure owes tons of money to many companies, is owed a REFUND of over $11,000.It states that I might have an interest in these monies if he is dead. It only gives a fax number and email. Is this a scam?? If so, I believe this is highly illegal.Anyone else receive a letter like this? I believe in if it's too good to be true, it probably is. I'm afraid if I contact them they will keep calling me looking for him. I just don't want to get on their radar for his money owed.

These *** call all the time looking for Goober, Grady, Greg, Grace, Gooshy, Goo Goo, Ganjamon, Geona, Gee Gee, Gruce, Goodness, Gangrene and any other *** up *** first name with my same last name. I always tell them to *** *** but when I do it makes no difference, they just have some other crack *** call instead.

They want to find out if you received any money from his estate so they can lay a claim against it to collect the money they are owed. I am actually on this site looking up a similar issue for my uncle who just passed away in July.

I'm pretty sure whatever bills he had were from over 7 years ago so I am trying to decide the best way to pursue this.

Never respond in any way they use that against you or family members as incriminating evidence in court to help win cases/ judgments against you.

It is a ploy to gain any more information against the one they are after.

If they continue. File harassing or even stalking charges In some states multiple unwanted phone calls is a form of stalking and against the law charges can be filed.

Record the calls there are apps / services for that check your state for the rules on that.

AVOID that letter. Sounds like a phishing tactic to get your phone number in order to try to collect a debt of your father's from you (ie, harass you). It appears to be an attempt lure you in with a false offer of money, only to turn on you like a rabid street dog. You can't be held accountable for debts of anyone else (except maybe in some states a spouse).

Furthermore, if tell them to stop calling by law they have to stop. But tell them to cease ALL contact (mail, etc also) or you will take legal steps against them for harassment. If it's a letter you receive, respond with a letter; save the letter and it's best to get a Proof Of Mailing from the Post Office (which only costs a couple dollars, but would be well worth it). The debt might be sold to another agency, and just send them a photocopy of your letter to the previous agency.

Check your state and federal websites for your rights. most people aren't aware of their rights in these matters. You could also contact your state Attorney General's Office or Department of Consumer Affairs about the laws and your rights. I learned this from an Oprah episode years ago and it has severed me well a couple times with some crooked companies that didn't even attempt to resolve a dispute with me, and they sent it directly to a Collection Agency. In both cases I had requested in writing details about what they claimed I owed, but they didn't respond. I had thereby fulfilled my legal responsibility and they had not. One case involved an energy provider company that had fraudulently obtained my account and that of some of my neighbors. When their sales claims proved to be false, I switched back to my previous provider. The fraudulent company tried to charge me $200 to switch away from them, but "waived" that fee when I confronted them with their fraud and that I was reporting them to the Dept of Consumer Affairs and told them I welcomed them to sue me. However they sent me another bill with absolutely no data on the time period it allegedly covered. They never responded to my requests, and thus we entered the credit "dance".

Hilariously they hid their actions and the *** companies that buy the debt later don't research the (unfounded) debts they buy and it just keeps getting sold and passed around, proving the absurdity, bad judgement and actions of the financing industry.

Asset Acceptance reporting judgment/lien on debt discharged

Received word in May, 2012, that Asset Acceptance was suing me for a credit card debt. I filed bankruptcy (prompted by the suit) and received a discharge of debts in September. Now, in May, 2013, I am receiving alerts that a judgment/lien has been granted on this debt. I have received nothing from AA or anyone else in the mail. I filed an order for administrative closure due to bankruptcy this morning. I used the 2012 information (case # and other info) and was informed by the court clerk that there has been no activity on that case. I was relieved for a moment but then wondered if they had refiled or changed the case number so that I can't track it. I am very worried.

Rec'd 9,804 calls from Asset Mgt past 4 yrs

Asset Management debt-collectors call everyday, except for Sunday's and 3 main Holidays. To date, they have called me almost 10,000 times with no end in sight. I have only spoken to them 3 times and the conversations were so crazy, frustrating and exhausting I choose not to speak with them again. They have also called 2 family members even though I am still at the same location and number and have asked them to stop. I also sent them a certified 'cease & desist' letter. They refuse to provide Proof Of Debt. They call from different #'s all day, averaging 7-8 calls per day ... for 4 yrs ... about a debt they can't prove I owe because I don't owe it.

Changed time frame of purchase

Asset Accept apparently purchased a debt long since satisfied with Dell Financial in July 2012. This debt was for a company that has been defunct for years but had a personal guarantee. They've increased the debt by 32% per month since then and now have filed a garnishment suit against me personally. I've sent them numerous letters asking them for proof of ownership and to stop the 10 telephone calls per day (harassment). Now I'm going to have to hire an attorney which will cost money to defend an action that is no longer valid. I pulled a recent credit report and they've reported me to the credit bureaus as not having made a single payment on a loan from July 2012 (when they purchased the paper)

*** ACCEPTANCE said that I owe $5000.00 on a credit card that I never had in my life and I never had a $5000.00 credit card limit in my life. These *** call every day 4-6 times a day all hours of the day. They need to get a life as they are a bunch of losers that try to scam people and are a fraud. They all need to go to prison, and be fined thousands of dollars for their fraud. Watch out as they use all kinds of threats and language to try to make you believe that you owe money. Your best bet is to block them on your phone, and DO NOT answer when they call!!!

These people are calling my daughter

My daughter called me last night to tell me this company was calling her and telling her that I was using her address and phone number. I have never done this and am furious that this company would contact her and make such an accusation. I don't know who they are or how they got my daughter's information. This has to be illegal and must be stopped. I don't even know what debt they are trying to collect on. I have never received anything in the mail or a phone call from them, so how am I to know what I supposedly owe anyone.

PAID OFF CREDIT CARD, ASSET STILL TRYING COLLECTION

I had an outstanding bill with a retail credit card for some time. I sent a letter and payment in full to World Financial Network Ntl Bank who owned the credit card. The Bank accepted the payment, the credit card was now paid in full and the account closed. Not long after I started receiving collection letters from Asset Acceptance LLC demanding payment for more than twice the original statement. I sent Asset a copy of the letter and money order that I sent to the bank and restated that the account was paid in full and closed. That was about FIVE years ago. They continue to call beginning at 8am up to 9pm and call 8 - 10 times a day. They use many different phone numbers to call from. They make Loan Sharks look legal.

Did Asset have the debt? If they did, then paying the original credit issuer was the wrong thing to do.

It sounds like the credit card bank either turned over or sold the debt to Asset. So when you paid, you should have paid the entity that actually had the debt. Now, the bank has your money (and they literally get hundreds of payments a week so it will take some time for them to figure it out), and Asset is waiting for payment.

The bank will now have to notify Asset of your payment so close the account.

In this case, it sounds like the issue would be with you and the bank. Asset is just the collecting house doing what the bank paid them to do.

Letter from asset acceptance,llc

i got a letter from asset acceptance ,llc company from address po box 2036 warren, mi 48090-**** it was regarding my debt which i have no idea of. I have never taken credit from anybody till now and i haven't even applied for credit card till now. I called to the company and i talked to a guy he asked my 4 last numbers of social security and my date of birth i gave it to him and he said it was wrongly send to me. but i am afraid that whether i had to give him my information or not or this company is fraud one or no. please response me about this matter.

Send them a letter by CMRRR and state

this is not your debt,

they should not contact you again regarding this matter,

that if they do you shall enforce all your rights per FDCPA, FCRA, TCPA, and state laws

that all calls are inconvenient.

Just print your name do not sign (they forge your signature)

They know that you have used the law to put the brakes on them and they hate you now because they know you are not ignorant of your right. Set yourself up for when they will violate your rights (in your letter). Make sure your phone can record a call. Google if your state is one or two party. If one party you don't have to tell them you are recording if it's two party listen for then part where they say this call may be recorded and that is your permission to record.

The goal is to collect slam dunk evidence. IT's better in court than he-said, she-said.

If they call, or make any contact whatsoever, record the call, they just violated FDCPA and you are now due $1000. Get a consumer attorney at collectionbully.com or NACA.org (that's another $3000 it will cost them just for violating your letter)

I AM SICK OF THE CALLS!!!

When I see the name & number of asset acceptance on my home phone, I simply don't answer. I've had at least 3-4 calls per day. When do these people get the hint?? I do not and will not answer these calls!! Will you take me OFF your list!!! I have Multiple Sclerosis and many times the calls come when I'm trying to rest or take a nap. Fatigue is one of the most common side affects of M.S. I also have balance issues so cannot get around well. Please stop interrupting my already boring days. ckandrick@***.net

Just a word of advice, maybe if you answered your phone and let them know they had a wrong number they probably wouldn't call anymore.. You can't expect them to be psychic

Stole money out of checking account

Asset Acceptance stole $1000.00 of my husbands money somehow right out of our checking account. Over 10 yrs ago I made a mistake with a credit card and unmarried. I do not work but I tried to make arrangements with this company to make payments. Instead, they stole my husbands money! DO NOT TRUST THESE PEOPLE! DO NOT GIVE THEM ANY OF YOUR PERSONAL INFORMATION EVEN TO MAKE PAYKMENTS. SEND THEM A MONEY ORDER IF YOU HAVE TO. THIEVES! They even took me to court and I had to pay a lawyer $400.00 to try to get my money back!

Asset Acceptance fraudulent and illegal

I sent this letter to Asset Acceptance who filed a lawsuit against me and never served me:

This letter is sent in response to several anonymous phone calls I've received in which you don't identify yourself when leaving messages (I googled your phone number); and a letter from an attorney willing to represent me because you filed suit against me in 18th District Court in Westland, MI. I have not even been served and this attorney found the listing and contacted me.

I am requesting that you provide validation of this debt. Under Fair Credit Collection Practices ACT, this debt falls under the "Time-Barred Debt" section. In the State of Michigan this is 6 years (http://www.legislature.mi.gov).

If you do not comply with this request, I will immediately file a complaint with the Federal Trade Commission and the State of Michigan Attorney General's office. Civil and criminal claims will be pursued.

Asset Acceptance LLC is a SCAM full of *** artists. Now, what intriques me is that NONE of you, from all the research regarding Asset Acceptance LLC, have ever reported about their agents' bar licenses???

I am involved in a such case at the moment, and I found out that they post attorneys who just got their bar license either renewed or just recently approved just to file a lawsuit against me on the same day. Very suspicious. Always CHECK their licensing.. if its identical to what I just said here, then you should FILE a report with FTC on this issue, because it can be illegal in a form that a newly assigned attorney who just got his bar license to VIEW your SOCIAL SECURITY NUMBERs.

Do research and you'll find out just how freaken dirty they really are. Sad enough, FTC did not satisfy enough of their dirty lawsuit against Asset. They should keep on suing over and over again and rip Asset off the face of the earth.

They're nothing but *** bags.

Just thought to post this so you could look this part up regarding their bar licenses !!!

They just called me about one of my late husband's business accounts and he died over 12 years ago. I work for collections so I know the rules of the game they were trying to play with me.

I told them this is past stats and I'm not liable as I was not a part of the company and they said no we can't sue but we will proceed.

Whatever, don't threaten me and if they call me again and I'm filing a complaint with the FTC. I googled them looks like they have already had one class action lawsuit against them, not a very reputable company at all!

Attempt to settle accounts

2007/2008 I was a victim of identity theift. I attempted to contact the companies involved, some were cooperative others were not i was so overwhelmed by the enormity of the losses i decided to file bankruptcy. I never filed bankruptcy & many of the problems have since been resolved. I have a few things i want to settle & I contacted Asset Acceptance via the mail to try to work out a settlement agreement & i never received any communication via the mail. I called them & was brutalized by them on the phone. I have tried to speak with them & I have requested a written offer from them but they refuse to provide this to me. How can I settle this account without the mental abuse?

Do you owe this debt or is it part of the ID theft? If so you do not owe anything to a soul.

If you legitimately owe this debt when was the last time you made a payment on it? Make sure if your state SOL on debt has expired or not. If it has expired you do not have a legal obligation to re-pay the debt, unless you care to. No one can sue you, etc. And if they do you just show up in court and prove to the judge the debt SOL is expired, case dismissed. Then you turn around and file a false collection suit and collect $1000 from them. You can even make it expensive for them by hiring a consumer attorney at collectionbully.com or NACA.org, as that's about another $3000 they have to pay.

Now back to this issue, only if you owe.

Never talk to them on the phone, don't beg, don't take any abuse from them, just end the call. Instead you need to Google what are your rights under FDCPA, what to do when contacted by a debt collector. FDCPA give you a lot of power to control how a debt collector (DC) behaves with you. But DC hope you don't know your rights so they abuse you to make you emotional so you can pay a debt. Don't fall for it. Instead set yourself up to collect against them. IF you have to talk on the phone do so only if you can record the call. Google if your state is a one party or two party. If you get this call may be recorded or ask them then that is your ok to record also. Texas is a party state so you don't have to tell the other person you are recording.

The reason you record is to have slam dunk evidence when they violate FDCPA, TCPA, State laws. It's better evidence than he-said she-said.

If you don't want to talk to them on the phone send a letter by CMRRR and request for a validation of debt; in the letter state all calls are inconvenient, they should contact you by mail only. They are supposed to stop collection efforts immediately, and you VOD within 30 days. IF they try to collect before they validate, they just violated FDCPA and you are due $1000 right there.

A debt validation is everything about the account, the original contract with your signature, accounts statements, etc, everything. VOD is not a letterhead stating you owe this much.

If they fail to validate they are supposed to not attempt to contact you to collect. If they contact and never validated, the have broken FDCPA law, time for cha shing for you, $1000.

If they validate and you owe this debt and SOL is not expired don't just pay. Negotiate the debt to a 1/3 or less than 1/2. When yuo agree on a figure tell them to send you an offer of settlement. No offer, no $$$ from you.

Once you have the offer mail a cashiers check or a money order, not a personal check nor give them electronic access to draft your account - they will clean you out.

Stape the evidence the check was paid to th eoffer settlement letter and keep everything for life - they resell your paid off debt in the future then it's the same collections story again.

AT this point post for further advice at debtorboards.com. IF you need a consumer attorney dave ramsey endorsed at collectionbully.com or search at NACA.org. Look for one that will take your case on contingency basis but get good evidence.

Harrassing calls from Asset Acceptance

I received my current telephone number about two years ago. Since then I have been continually plagued with calls from "Asset Acceptance"; my answering machine usually gets them but they are so long-winded they fill up the available space, often being cut off mid way. Twice I have fielded the call myself, informing the person on the other end that I was not the person they seek and to please stop calling me. They promised to "remove me from the list" but a couple of months later the calls start again. Their robot message says "if you are not (name) please hang up now", I've picked up and hung up at least twice ..to no avail. Today I actually caught a return phone number, I am giving it to the phone company with a formal complaint.

You do have rights under the federal law, the Fair Debt Collection Practices Act. And we do PURSUE AND SUE these companies that are harassing people.
