So I call my bank one day and find out I have exactly $0.00 - which doesnt make sense because I had $47 something in there - just enough for gas and food till payday. I call the bank and find out Asset Acceptance has gotten a judgement to take the money.

I never got any thing in the mail stating there will be an upcoming court date - I haddnt had bills from them in years - this dept is from 15 years ago - they say I owe over $5.000 - which - I doubt. I havent been sent anything from them in a long time - now they take money out of my account with NO WARNING!

I got a piece of mail today from their lawer stating they have a judgement against me, days after the fact. Isnt this illegal?

Monetary Loss: $5.

Location: Plymouth, Minnesota

This illegal, the same thing happened to us, except they took 11 grand after taking 89 hundred 4 years earlier on the same bill. A bill that started off being only 3400.

We finally found a Lawyer that was more than happy to take the case and he did not charge us up front he said he would collect from them. He sued them and we got back all of our money settled out of court, lawyer got paid and we got a letter from the courts that the judgement was satisfied. But yes how they get away from just garnishing your wages to stripping your bank account, with fake made up numbers the court system needs to put a completed stop to this. Asset Acceptance is a completed scam and rip off company the needs to be shut down.

The law should stop company's from buying debts from other company's. Because this gets reported on your credit report twice.

If the statue of limitations is past 7 years, but this collection still shows on a credit report, how can it be removed?

i had this lawyer after got served by the police of them suing me he told me they dont have any proof i owe anything since they bought my loan so i gave him 500 dollars i didnt even have to go to court he did and now its dismissed

If the debt is over 7 years old they cannot collect on it any longer and it is illegal. The only exception is that if you have paid anything on this debt in the past 7 years.

No, it is legal, and you have a major battle on your hands. The court clerk will have information on the judgement against you, but they will garnish your wages next. Get moving and see if you can get the judgement cancelled due to incorrect service of the papers.
