Written by tj, on 18-09-2008 17:18 In order to have standing to sue a reporter of erroneous information on your credit report, you must first send a dispute to the credit reporting agency (i.e. TU, Equifax, Experian). They then forward that to the company that reported it, who must either correct what they are reporting, or remove it. (If they fail to reply to the dispute, it must be removed.) If the error is falsely "verified", you can then sue the company reporting the false information, under FCRA. The credit reporting agencies routinely ignore letters from consumers, regardless of the law, so you force the issue as above. It's false, you dispute, they verify, you sue. |
